Massachusetts Construction Debris Disposal Bans

Massachusetts bans certain construction and demolition materials from disposal, requires C&D waste to be kept separated, and places responsibility on both the generator and the transporter. This guide states the rules as MassDEP publishes them, with a link beside each one. Scope: Massachusetts statewide.

What is banned, and since when

  • The waste bans are at 310 CMR 19.017, in the Solid Waste Management Facility Regulations. — MassDEP
  • Banned from disposal under 310 CMR 19.017: asphalt pavement, brick, concrete, metal, wood, and clean gypsum wallboard. — MassDEP
  • The bans on asphalt pavement, brick, concrete, metal and wood took effect July 1, 2006. The ban on clean gypsum wallboard took effect July 1, 2011. — MassDEP
  • Wood may be disposed of at municipal waste combustion facilities. — MassDEP

How loads must be separated

  • 310 CMR 19.000 defines C&D waste to include concrete, brick, asphalt pavement, masonry, plaster, gypsum wallboard, metal, lumber and wood. — MassDEP

Who carries the rule

Both the organizations that generate solid waste and those that transport it to disposal facilities are responsible for complying with the Massachusetts waste bans. The generator and the transporter both carry it. — MassDEP

Questions to ask, and whom to ask

  • Is this load separated into the categories 310 CMR 19.000 lists — asphalt, brick and concrete; wood; metals; plaster and gypsum — before it leaves the site? — ask the generator, who carries the rule (MassDEP)
  • Does the receiving facility accept each banned material under 310 CMR 19.017? — ask the facility and MassDEP (MassDEP)
  • Is wood going to a municipal waste combustion facility, where MassDEP says it may be disposed of? — ask the transporter (MassDEP)
